
Uses of the Trust
The decision to set up a trust derives from the observation that this institution is often the only one in our legal system that effectively enables otherwise unattainable objectives to be achieved. The so-called internal trust, which can legitimately be resorted to in Italy, is the legal instrument that is least likely to achieve unlawful purposes. Thanks to its flexibility, the trust permits the pursuit of a multiplicity of purposes worthy of protection and makes it possible to obtain a protective effect of assets and rights, known as segregation, of general scope and usable by anyone. There are many possible uses of the trust, some significant examples are:
- planning the generational transfer of a business
- estate planning
- protection of a disabled person
- protection of de facto couples
- charitable purposes
- devolution of life insurance policies
- instrument in the mortgage
